01 Acceptance of These Terms

These Terms of Service (“Terms”) govern your use of jjnre.com (the “Site”) and the services offered by Jonathan J. Nelson Real Estate (“we,” “us,” or “our”), an independent real estate brokerage located at 9 N. Main Street, Pittston, PA 18640. By using the Site, submitting a form, or opting in to our text-messaging program, you agree to these Terms. If you do not agree, please do not use the Site.

02 Use of the Site

You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt to access it in an unauthorized way, or use it to transmit harmful or misleading content. We may modify, suspend, or discontinue any part of the Site at any time without notice.

03 Property Information & Listings

Property listings, prices, availability, market figures, and home-valuation estimates on the Site are provided for general informational purposes and are drawn from the multiple listing service (MLS) and other sources believed to be reliable but are not guaranteed. Information is subject to change without notice and does not constitute an appraisal, an offer, or a binding representation. Please verify all details directly with us before relying on them.

04 No Professional Relationship Until Engaged

Using the Site or contacting us does not, by itself, create an agency, brokerage, or fiduciary relationship. A client relationship is formed only through a written agreement. Nothing on the Site is legal, financial, or tax advice.

05 SMS / Text Messaging Program

By providing your mobile number and opting in, through a form on this Site or directly with one of our agents, you consent to receive recurring SMS text messages from Jonathan J. Nelson Real Estate at the number provided, including messages sent using automated technology. Consent to receive text messages is not a condition of purchasing any property, product, or service.

Messages may include property inquiries, appointment scheduling and reminders, showing confirmations, listing updates, transaction milestones, document requests, market updates, and customer-service communications, and, where you have asked us to watch for properties meeting your criteria, an alert when a match is listed. We do not send marketing blasts, newsletters, or promotional campaigns by text.

The number we text from. Our messages come from (570) 569-0934, a messaging line that is not answered as a phone. The office line is (570) 212-9583.

Frequency & cost. Message frequency varies based on your relationship with the brokerage and the stage of your transaction. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opt-out & help. Reply STOP to any message to unsubscribe at any time; you will receive a confirmation and no further messages unless you opt in again. Reply HELP for assistance, or contact us at (570) 212-9583 or communications@jjnre.com.

Privacy. No mobile information, phone numbers collected for SMS, or SMS opt-in consent will be sold or shared with any third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for how we handle your information.

06 Intellectual Property

The Site’s content, branding, logos, and design are the property of Jonathan J. Nelson Real Estate or its licensors and are protected by applicable law. You may not reproduce, distribute, or create derivative works from it without our written permission, except for MLS content used in accordance with its provider’s terms.

07 Third-Party Links & Services

The Site may link to or rely on third-party services, including MLS/IDX providers, mapping, analytics, and messaging platforms. We are not responsible for the content, availability, or practices of those third parties.

08 Disclaimers & Limitation of Liability

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, Jonathan J. Nelson Real Estate is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or the messaging program.

09 Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Luzerne County, Pennsylvania.

10 Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to this page. Your continued use of the Site or the messaging program after changes are posted constitutes acceptance of the updated Terms.

11 Client Portal Terms of Use

The JJNRE Client Portal is a Virtual Office Website. Through it, a client we have an established relationship with can see listing information from the MLS that is not published on the public site. Access is by invitation from your agent, and before the portal shows you that information you are asked to agree to the terms in this section. We record that you agreed, and to which version.

By creating or using a Client Portal account, you acknowledge and agree:

• That you have entered into a lawful consumer-broker relationship with Jonathan J. Nelson Real Estate.
• That all data obtained from the portal is intended only for your personal, non-commercial use.
• That you have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the portal.
• That you will not copy, redistribute, or retransmit any of the data or information provided, except in connection with your consideration of the purchase or sale of an individual property.
• That you acknowledge the MLS's ownership of, and the validity of the MLS's copyright in, the MLS database.

You also authorize the MLS and other MLS participants, or their duly authorized representatives, to access the portal for the purpose of verifying compliance with MLS rules and monitoring the display of participants' listings through the portal.

We email you a confirmation when you agree to these terms. Your portal access expires one year after you first sign in; you renew it by resetting your password from the link we send to your email address. We keep the record of your account, and of your agreement, after your access ends.

Nothing in this section creates a financial obligation or an agency relationship. Any agreement that does either is a separate document, labeled as such, and is never entered into by clicking a box.
